What is a Right of Way

Welcome to Land registry HM Easements and Rights of Way advice pages. To the left you will see a directory of articles and guides relating to easements and the common questions and issues relating to them.

Easements are in the most common form, rights of way; the right of one party to cross over the property of another. Other common easements are for the discharge of drainage, the passage of utilities and similar such service agreements.

Our Easements advice pages should provide a good guide of guide of what you can and cannot do relating to easements and rights of way, their use, establishment and discharge (removal).

It should be noted that easements are one of the most complex and contentious areas of property law and should always be addressed by senior counsel (a barrister).
