There is rarely an obligation upon the land owner to fence a property there are some points of note however:

There may be a restrictive covenant stipulating the erection of a fence. Details of such a covenant would be found within the Title Register and Title Deeds

On the same hand there may be a restrictive covenant prohibiting the erection of a fence in an open plan community. Details of such a covenant would be found within the Title Register and Title Deeds.
